About
Couch White's Construction Practice Group represents owners, contractors, subcontractors, design professionals, government agencies, lenders, sureties, engineers, and public and private developers in a broad array of construction law matters. We provide a full range of services to our clients from planning, contracting and administering a project to resolving disputes through negotiation, arbitration and trial. We are well regarded in the construction industry for bringing forward thinking solutions to complex business and legal challenges. Because construction projects often involve land use, permitting and environmental issues, our attorneys have expertise in these areas to ensure that our clients receive the best and most comprehensive legal advice possible. Couch White has extensive experience with public bidding and contract negotiations. We are familiar with state and federal bidding laws and procedures and often advise and counsel on the bidding process, including bid protests and mistake-in-bid actions. Couch White attorneys draft, review and negotiate construction contracts, such as prime contracts, design/build, architect/engineer, construction management and subcontract agreements. Our in-depth knowledge of the unique features of the construction industry enables us to review contracts prior to award or execution to ensure that our clients understand the contract, its pitfalls and risks, and obtain the best possible terms. Insurance and surety bonding are additional areas of focus. We understand the intricacies of commercial, general liability, property and professional liability insurance. We represent sureties, owners, contractors and subcontractors on surety bond claims. At Couch White, we believe that good project management is key to avoiding disputes. We provide sound advice and strategies to resolve performance and payment problems before they can threaten the successful completion of a project. If a dispute cannot be avoided, our attorneys have the experience and resolve needed to successfully prosecute or defend claims. Project documentation is critical and we advise clients on how to document their position so that evidence needed to help prove or defend a claim is preserved. When disputes arise, Couch White makes every effort to achieve early resolution. We seek early resolution through dispute resolution boards and mediation. Our substantive knowledge of construction laws, rules and regulations enables us to furnish these services in a result oriented and cost-efficient manner. Our attorneys pursue and defend a variety of claims, including breach of contract, payment, warranty, design defects, delays, extra work and even fraud. Couch White meticulously plans discovery, motions and trial preparation to maximize results and minimize costs. We assign tasks among our lawyers and paralegals to maximize efficiency and limit client expense. Our construction attorneys frequently handle sophisticated, complex, legal matters in both federal and state courts. Couch White has been involved in a number of cutting edge construction cases, including: - New York Court of Appeals decision holding that the design/build form of construction project delivery is legal in New York.
