Macdonald Devin has an active practice defending claims arising out of exposure to toxic materials and substances including chemicals, lead, mold, benzene, silica and asbestos-containing products. Our attorneys have many years of experience defending manufacturers of asbestos-containing materials and are actively defending claims based on emerging theories of premises liability, employer liability, and distributor liability. Macdonald Devin represents manufacturers, distributors, premise owners and employers in all aspects of complex product liability and toxic tort litigation in state and federal courts nationwide. We also serve our clients by acting as regional and national coordinating counsel in matters involving similar claims in multiple jurisdictions. Our attorneys have extensive knowledge of applicable law that enables them to counsel manufacturers and service providers on ways to prevent lawsuits from being filed, such as through analysis of product warnings and manufacturing practices. Macdonald Devin's lawyers are also familiar with experts in the various fields and are skillful at assembling teams of physicians, neuropsychologists, toxicologists, and other experts. Because toxic tort cases frequently involve many defendants relying upon the same medical and causation defenses, our lawyers routinely play leading roles in preparing common defenses for joint defense groups. This coordinating role requires not only the development and presentation at trial of common experts, but also requires our lawyers to take the lead in presenting legal arguments common to all defendants.
